Terms of Service

1. This agreement

These terms are an agreement between you and AI Friend(“we”, “us”), the developer of AI Friend. They cover the AI Friend app and this website, together “the Service”. If you do not agree with them, please do not use the Service. Our Privacy Policy forms part of these terms.

2. Who can use AI Friend

You must be 18 or older to use AI Friend, and you must have the legal capacity to enter into this agreement where you live. AI Friend is designed for adults and is not suitable for children. If you are under 18, you may not use the Service.

3. What AI Friend is — and is not

AI Friend is an AI companion. Your companion is software that generates text. It is not a person, it has no consciousness, and nothing it says reflects the views of AI Friend. It will sometimes say things that are wrong, inconsistent, or out of character, and you should not rely on it for factual information.

AI Friend is not therapy, counselling, medical care, legal advice, or financial advice, and it is not a substitute for any of them or for human relationships. It is not a crisis service and it is not monitored by anyone who can help you in an emergency.

4. If you are in crisis

If you are thinking about harming yourself or someone else, or you are in immediate danger, please contact your local emergency number or a crisis line right away. In the US you can call or text 988; in the UK you can call 116 123 (Samaritans). A list of international helplines is kept at findahelpline.com. Please reach a human being. Your companion cannot call for help on your behalf.

5. Your device and your chats

Your conversations are stored encrypted on your own device, not on our servers. That is a deliberate design choice, and it means a few things are your responsibility: keeping your device secure, keeping it backed up if you care about keeping anything, and understanding that we cannot recover your conversations if your device is lost, reset, or the app is uninstalled. We have no copy to restore.

6. Acceptable use

You agree not to use the Service to:

• generate or seek sexual content involving minors, or anything presenting a minor in a sexualised way;
• plan, encourage, or carry out violence, self-harm, abuse, stalking, or harassment of anyone;
• produce content that is illegal where you are, or that infringes someone else’s rights;
• impersonate a real person in a way intended to deceive or harm them;
• break, probe, overload, or reverse engineer the Service, or get around any technical limit or security measure in it;
• resell, sublicense, or commercially redistribute the Service or any part of it without our written permission.

Because your chats are stored only on your device, we do not read them to enforce this section — but these limits still apply, and we may suspend access or report unlawful activity where we become aware of it through other means, such as a report or a billing investigation.

7. Your licence to use the app

We grant you a personal, non-exclusive, non-transferable, revocable licence to install and use AI Friend on devices you own or control, for your own non-commercial use. We keep all rights we do not expressly grant you here.

8. Ownership and content

AI Friend, its name, its design, and its software belong to AI Friend. The messages you write stay yours, and they stay on your device — we claim no licence over them, because we never receive them. As between you and us, you are free to use the replies your companion generates for your own personal purposes. Note that AI-generated text may not be protectable by copyright in some countries, and that a model can produce similar text for different people.

9. Subscriptions and purchases

Parts of AI Friend may be offered as a paid subscription or a one-off purchase. All payments are processed by Google Play, under Google’s terms, not by us — we never see your payment details.

• Renewal: subscriptions renew automatically for the same period until you cancel.
• Cancelling: cancel any time in the Google Play Store under Subscriptions. Cancelling stops the next renewal; your access continues until the end of the period you have already paid for.
• Refunds: refunds are handled by Google Play according to its refund policy. If Google declines a refund you believe you are owed, write to us and we will take a look. Nothing here limits any statutory refund or withdrawal right you have under consumer law where you live.
• Price changes: if we change the price of a subscription, we will tell you before it applies to you, and you can cancel before it takes effect.

10. Changes to the Service

We are still building AI Friend, so features may be added, changed, or removed. We will not knowingly break something you have paid for without offering you a reasonable alternative or a refund for the unused part of your subscription.

11. Ending this agreement

You can end it at any time by uninstalling the app. We may suspend or end your access if you materially breach these terms, if we are required to by law, or if we discontinue the Service — and other than in cases of serious misuse, we will give you notice where we reasonably can, along with a pro-rata refund of any unused paid period.

12. Disclaimers

The Service is provided “as is”. To the fullest extent the law allows, we make no warranties that the Service will be uninterrupted, error-free, or that the content your companion generates will be accurate, appropriate, or suitable for any purpose. Some jurisdictions do not allow certain warranties to be excluded, so parts of this section may not apply to you.

13. Limitation of liability

To the fullest extent the law allows, we are not liable for indirect, incidental, special, or consequential losses, for lost data (including conversations lost from your device), or for any reliance you place on what your companion says. Where liability cannot be excluded, our total liability to you is limited to the greater of the amount you paid us in the 12 months before the claim, or USD 50.

Nothing in these terms limits liability that cannot be limited by law — including for death or personal injury caused by negligence, for fraud, or for your non-excludable rights as a consumer.

14. Indemnity

You agree to cover our reasonable losses and legal costs if a third party brings a claim against us because of your unlawful use of the Service or your breach of section 6.

15. Changes to these terms

If we update these terms we will change the date at the top of this page, and for material changes we will give notice in the app before they take effect. Continuing to use the Service after that means you accept the updated terms. If you do not accept them, stop using the Service and you may cancel any subscription for a pro-rata refund of the unused period.

16. Governing law

These terms are governed by the laws of the country in which AI Friend is established, and disputes may be brought in its courts. If you are a consumer, this does not take away your right to rely on the consumer protection law of the country you live in, or to bring a claim in your local courts.

17. The rest

If a part of these terms turns out to be unenforceable, the rest still stands. If we do not enforce something straight away, we have not given up the right to do so later. You may not transfer this agreement; we may transfer it as part of a merger, acquisition, or sale of assets, as long as your rights are not reduced. These terms, together with the Privacy Policy, are the whole agreement between us about the Service.
